These Terms of Service (“Terms”) govern your access to and use of DayDeck (the “Service”). By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. Eligibility and accounts

You must be at least 13 years old (or the minimum age required in your country) and capable of forming a binding contract. You're responsible for activity on your account and for keeping your credentials secure. Notify us promptly of any unauthorized use.

2. The Service

DayDeck connects to third-party services you authorize (such as Gmail, Google Calendar, Outlook, Jira, Linear, and similar tools) to aggregate, prioritize, and act on your work. You are responsible for ensuring that you have the right to connect those accounts and that your use of the Service complies with the terms of the underlying services.

3. Your content

You retain all rights in the content you bring into the Service (“Your Content”). You grant DayDeck a limited, worldwide, non-exclusive license to host, process, transmit, and display Your Content solely to operate and improve the Service for you. We don't sell Your Content and we don't use it to train third-party AI models.

4. AI features

The Service uses artificial intelligence to summarize, prioritize, and draft responses. AI output can be inaccurate or incomplete. You are responsible for reviewing AI-generated content before relying on or sending it. Do not use the Service for decisions that require professional advice (legal, medical, financial) without independent verification.

5. Acceptable use

You agree not to:

  • Use the Service for any unlawful, harmful, or fraudulent purpose.
  • Reverse engineer, scrape, or attempt to extract source code or data, except as permitted by law.
  • Interfere with or disrupt the Service or the networks or services connected to it.
  • Send spam, malware, or other harmful content through the Service.
  • Use the Service to violate the rights of others, including privacy and intellectual property rights.

6. Fees

DayDeck may offer free and paid plans. If you sign up for a paid plan, you authorize us to charge the payment method you provide on a recurring basis until you cancel. Fees are non-refundable except where required by law.

7. Termination

You can stop using the Service at any time by deleting your account. We may suspend or terminate access if you breach these Terms or if we're required to do so by law. Sections that by their nature should survive termination will survive.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUT WILL BE ACCURATE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAYDECK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $100 IF YOU HAVE NOT PAID US.

10. Indemnity

You agree to indemnify and hold DayDeck harmless from any claims, losses, and expenses arising out of your use of the Service or your violation of these Terms.

11. Changes to the Terms

We may update these Terms from time to time. We'll post the updated version here and update the “Last updated” date. For material changes, we'll give you reasonable notice. Continued use of the Service after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the jurisdiction where DayDeck is established, without regard to its conflict of laws principles. Disputes will be resolved in the competent courts of that jurisdiction, unless local law gives you the right to use a different forum.
